Store Regulations

§1 General Provisions.

  1. These Regulations set out the rules for the provision of electronic services, including the rules of sale in the online store available under the Internet domain www.taotaospa.pl/sklep (the “Store”), whose manager is: TTS GROUP SP. Z O.O., ul. Szlak 77/222, 31-153 Kraków, NIP 6762667125, KRS: 0001100254. The Seller and the operator responsible for IT and logistic support of the Store is TTS GROUP SP. Z O.O., ul. Szlak 77/222, 31-153 Kraków, NIP6762667125, KRS: 0001100254. The entity providing online payment services is Autopay S.A.
  2. The store conducts only retail sales of products presented on its website, offering them exclusively for the customers’ own use. Any order, the content or circumstances of which indicate that it was made for profit-making purposes, will be considered invalid and not placed, of which the Customer will be informed in an e-mail.
  3. Sales in the Store take place via the Internet in the form of a distance contract between the Customer and the Seller.
  4. Technical requirements for the proper functioning of the information and communication system used by the Store: connection to the Internet, a web browser or an appropriate application, having and providing an email address to send information about the implementation of the order.
  5. The customer, using the services described in these regulations, is prohibited from providing content of an unlawful nature.
  6. The seller provides electronic services in accordance with these terms and conditions.
  7. All information regarding the processing of personal data can be found in the Privacy Policy available on the Store’s website http://taotaospa.pl/polityka-prywatnosci/.
  8. Communication of the Store with the Customer is carried out via: e-mail: sklep@taotaospa.pl, telephone: +48 603 892 782.
  9. Terms used in these Regulations mean:
  10. Order processing time – is the time that counts from the moment the Store confirms acceptance of the order for processing, and ends when the Customer receives the ordered goods;
  11. Working days – all days of the week from Monday to Friday, excluding public holidays;
  12. Consumer – according to Article 221 of the Act of April 23, 1964 of the Civil Code, a natural person making a legal transaction with the Seller that is not directly related to his/her business or professional activity;
  13. Shopping cart – an element of the Store, by means of which the Customer specifies the details of the order, such as the number of products, delivery address, invoice details, delivery method, payment method, etc;
  14. Customer – a natural person with full legal capacity, a legal person or an organizational unit without legal personality, but with legal capacity, who uses the Store, in particular, visits it, registers or / and purchases in the Store under the terms of these Regulations;
  15. A cookie – a small piece of information stored by the server on the customer’s device in the form of a file, which the server can read when the customer reconnects from the same device.   16. Privacy Policy – a document containing information on personal data processed by the Seller, available on the Store’s website http://taotaospa.pl/polityka-prywatnosci/;
  17. Store – an online store available under the Internet domain http://taotaospa.pl;

  19. Product Page – a page in the Store that presents information about the offered product;
  20. Sales contract – a contract of sale concluded remotely, under the terms of these regulations, between the Customer and the Seller.

§2 Placing Orders.

  1. In order to place an order in the Store, the Customer should use the latest versions of Internet browsers. He should have Java Script and cookies enabled.
  2. In order to complete the Customer’s order, it is necessary to provide the delivery address (name, street, postal code, city) and contact information (name, phone number, email address). Providing data such as first name, last name, mailing address, email address, telephone number, is completely voluntary and will not be used in any other way than to fulfill the order placed by the Customer in the Store. Lack of such data will prevent the order from being processed.
  3. You can place an order without registering an account with the Store or through a registered account.
  4. The customer can place orders in the Store 24 hours a day. The Customer places an order by indicating the product on the Product Page that he/she is interested in – the ‘Add to Cart’ command, and then in the Cart in the following steps indicates the method of receipt and payment for the order.
  5. By placing an order, the Customer declares that the purchase of products in the Store is not for profit and is intended solely for his personal use.
  6. Successful order placement is understood as the process of passing all 4 stages (steps) of order placement and confirming with the ‘Order and pay’ button. Confirmation of the order by clicking the ‘I order and pay’ button involves the obligation to pay for the order.
  7. The contract of sale between the Customer and the Seller is concluded upon receipt by the Customer of the email message that the Seller sends after the Customer has placed an order. The email message includes confirmation of receipt of the order by the Seller, together with all relevant elements of the order.

§3 Prices of goods.

  1. The store posts information about its offerings on the Product Sites and offers goods via the Internet.
  2. The prices on the Store’s website listed next to the offered product on the Product Page include VAT and are given in PLN; they do not include possible delivery costs.
  3. Information on the total value of the order, including: the price of the product, shipping costs and costs for payment processing in the case of PayPal payment form, is presented after the Customer selects the form of delivery of the order and the form of payment – in the third step of the Shopping Cart.
  4. Each transaction is confirmed by a VAT invoice expressed in PLN. Delivery costs, if any, are included in the invoice. The Seller shall provide the Customer with an invoice or invoice correction in paper or electronic form.
  5. On the Product Pages of the Store, a promotional offer may be made available, based on which the prices of goods will be reduced. Promotions in the Store are not cumulative unless the rules of a given promotion provide otherwise.

§4 Forms of payment and delivery.

  1. Payment for ordered services can be made by credit card, online transfer or traditional bank transfer. Current forms of payment are specified on the Store’s website under the tab: “Forms of payment”.
  2. Shipping of electronic vouchers is carried out to all countries of the world.
  3. It is not possible to send vouchers by mail, courier, shipping company.
  4. Payment methods available:Payment cards:

    * Maestro.

§5 Order Processing.

  1. Completion of the order should be understood as the completion of all stages of processing: from the start of the order process, through the transfer of the shipment to the courier company, to the transfer of the shipment to the customer.
  2. The execution of the contract of sale concluded between the Customer and the Seller begins with the preparation of the goods for shipment, which involves crediting the Seller’s bank account.
  3. The order processing time is from 1 to 10 working days. Electronic vouchers are sent to customers by e-mail during the working hours of the Tao Tao Spa outlet, i.e. Monday through Friday – 12:00 – 21:00, Saturday and Sunday – 11:00 – 20:00.
  4. The customer has the right to make changes to the order or withdraw it until it is shipped.

§6 Terms of complaint (notification of defects of the sold thing).

  1. For contracts concluded from December 25, 2014, the basis and scope of the Seller’s liability to the Customer under the right of warranty for physical and legal defects, is determined by the Civil Code Act of April 23, 1964.   2. The seller is liable under warranty if a physical defect in the goods is discovered before the expiration of two years from the date of delivery of the item to the customer.
  3. The customer has the right to request an exchange or refund when the service has been performed in a defective manner. The customer is obliged to immediately notify the Spa reception of the defect.
  4. The seller will respond to the customer’s requests no later than within 14 days.

§7 Withdrawal.

  1. In accordance with the Law of May 30, 2014 on Consumer Rights, the Customer who is a Consumer has the right to withdraw from the contract within 14 days, without giving any reason and without incurring any costs, except for costs related to costs other than the cheapest ordinary cost of delivering the goods and direct costs of returning the goods to the Seller. To meet this deadline it is sufficient to send before its expiration, via e-mail to: sklep@taotaospa.pl or by mail to the address: Tao Tao Spa – the Seller’s data above, a statement in writing – you can fill out a withdrawal form for this purpose.
  2. In the event of withdrawal from the Contract, the Contract is considered not concluded and the Consumer is released from all obligations. The Consumer is liable for any diminution in the value of the thing resulting from the use of the thing beyond what is necessary to ascertain the nature, characteristics and functioning of the thing, unless the Seller has not informed the Consumer of the right to withdraw from the Contract. In accordance with the Law, the deadline for refunding the payment is 14 days from the date of receipt by the Seller of the Consumer’s statement of withdrawal from the contract. The Seller may withhold reimbursement of payments received from the Consumer until it receives the goods back or the Consumer provides proof of their return, whichever event occurs first.
  3. In accordance with Article 38 of the Law on Consumer Rights, the Consumer is not entitled to withdraw from the contract, among other contracts:
    • – in which the object of performance is a non-refabricated item, produced to the consumer’s specifications or serving to meet his individualized needs;
    • – in which the object of performance is an item that is perishable or has a short shelf life;
    • – in which the object of the service is an item delivered in a sealed package, which cannot be returned after opening the package for health or hygiene reasons, if the package has been opened after delivery.

§8 Matters not regulated by the regulations.

  1. Contracts are concluded by the Store in accordance with Polish law and in the Polish language.
  2. The provisions of Polish law, in particular the Law on Consumer Rights of May 30, 2014, the Civil Code, the Law on Provision of Electronic Services shall apply to matters not covered by these Regulations.
  3. Any disputes arising between the Seller and the Customer will be submitted to the competent courts in accordance with the provisions of the Act of November 17, 1964 Code of Civil Procedure.
  4. A customer who is a Consumer has the possibility to use an out-of-court method of processing complaints and pursuing claims through: Provincial Inspectorates of Trade Inspection, Permanent Arbitration Consumer Courts operating at the Provincial Inspectorate of Trade Inspection, Consumer Ombudsmen, Consumer Federation, Association of Polish Consumers. Information on how to access the aforementioned dispute resolution procedures and procedures, can be found at the following address: http://polubowne.uokik.gov.pl/.
  5. Consumers can also file a complaint via the ODR (online dispute resolution) platform available at the following electronic address: https://ec.europa.eu/consumers/odr/. The European ODR platform provides a single common access point for consumers and businesses to resolve out-of-court disputes regarding contractual obligations arising from an online sales contract and/or an online service contract.

§9 Final Provisions.

  1. These Regulations are available at the following address: Tao Tao Spa, 74 3 Maja Street, 05-825, Grodzisk Mazowiecki, as well as at the Store’s web domain www.taotaospa.pl. The Customer may access the Regulations at any time by accessing the Regulations tab on the Store’s website.
  2. The Seller allows the right to amend these Regulations for important reasons, in particular:
    • changes in legislation,
    • changes in forms of payment,
    • changes in delivery methods,
    • changes in the legal form of business activities.
  1. Changes to these regulations will not affect orders placed and processed. Orders accepted for processing are bound by the regulations current at the time of order.
  2. These regulations are effective as of 06/04/2021.
