TERMS AND CONDITIONS OF THE COMPETITION
“THIRD TAO TAO SPA SALON”

§ 1 General provisions

1. These Regulations (hereinafter: “Regulations“) set out the rules under which the contest entitled: “Third Tao Tao Spa Salon” (hereinafter: “Contest“).
2. The organizer of the Contest and the founder of the prizes is THAI THAI Spółka z ograniczoną odpowiedzialnością based in Warsaw, registered in the register of entrepreneurs of the National Court Register under the number 0000906758 (hereinafter: “Organizer“).
3. Only persons of legal age residing in the territory of the Republic of Poland can participate in the Contest (hereinafter: “Participants” or individually “Participant”).
4. Employees of the Organizer and members of their immediate family are not allowed to participate in the Contest. Members of the immediate family are understood as: ascendants, descendants, siblings, spouses, spouses of siblings, spouses’ siblings, spouses’ parents and persons in an adoption relationship with the above-mentioned persons.
5. Taking part in the Contest is tantamount to the Participant’s declaration that he or she has read, agrees to the content and undertakes to comply with the provisions of the Regulations.
6. The competition constitutes a public promise within the meaning of the Civil Code.
7. The contest is in no way associated with, sponsored, endorsed or conducted by Facebook.com. Facebook.com is a trademark registered by Facebook, Inc. The information provided by the person entering the Contest is information shared with the Organizer and not with Facebook.com. This information will be used solely for the purpose of conducting the Contest.
8. For the avoidance of doubt, it is stipulated that the Contest is not a game of chance, fantasy lottery, pari-mutuel betting or slot machine game, the outcome of which depends on chance within the meaning of Article 2 of the Act of November 19, 2009 on gambling games.

§ 2 Rules of participation in the Competition

1. To participate in the Contest, the Participant must publish in a comment under the Contest post the answer to the question: In what location will the third Tao Tao SPA salon be opened? If you choose the city of Warsaw – indicate the district.
2. The contest post will be published on the official profile “Tao Tao SPA – URSYNÓW” and on the profile “Tao Tao SPA – GRODZISK MAZOWIECKI” available at: www.facebook.com/taotaospaursynow and www.facebook.com/taotaospagrodzisk (“Contest Post”).
3. Participants can take part in the Contest from the moment the Contest post is published on Facebook, until 18:59 on the day the Contest ends, i.e. July 8, 2021 . Entries after this date will not be considered.
4. The Contest will not include entries that Facebook administrators delete or permanently disable access to, as a result of violations of Facebook’s rules and regulations.
5. Out of all people participating in the Contest, 1 (one) winner will be selected, who will be the first to provide the correct answer in the comment under the Contest Post.
6. The prizes provided for in the Contest (hereinafter: “Prizes“) are: 1 (one) single named invitation to a 60-minute Balinese or Thai massage at Tao Tao Spa.

§ 3 Competition Resolution

1. The Organizer, within three business days after the end of the Contest, will select a winner from among the Participants and notify the winner via a comment under the Contest answer on Facebook. Subsequently, the Organizer will ask the winner to contact him/her in a private message sent via Facebook in order to complete the address data for the delivery of the prize (name, surname, address for shipment of the Prize).
2. If the prizewinner does not respond to the message requesting personal information within 48 hours from the date the Organizer sends the message, he/she will forfeit the right to the Prize, and the Organizer then has the right to select another prizewinner and award him/her the Prize in accordance with the appropriate application of the provisions of the Regulations.
3. The prizes will be sent by courier or postal service in each case, within 30 days after the Organizer receives the relevant details of the winner.
4. In the event that the prize is not claimed by the winner or the prize cannot be delivered due to the winner providing incorrect contact information, the Participant forfeits the right to the prize, which remains the property of the Organizer.
5. Prizes are not exchangeable.
6. It is not possible to withdraw the value of the Prize in cash or to transfer its value to other purposes.

§ 4 Complaints

1. Complaints should be submitted in writing to the address of the Organizer’s registered office or in the form of e-mail addressed to: ursynow@taotaospa.pl
2. The complaint should contain the data of the person making the complaint and the circumstance giving rise to the complaint.
3. Complaints will be considered by the Organizer within 14 days from the date of receipt.

§ 5 Personal data

1. The administrator of the Participants’ personal data is the Organizer.
2. Detailed information on data processing in connection with the Contest is included in Appendix 1 to the Regulations.

§ 6 Final provisions

1. Regulamin dostępny jest pod adresem taotaospa.pl oraz w siedzibie Organizatora.
2. When entering the Contest, the Participant is obliged to act in accordance with the provisions of the Regulations and applicable laws.
3. In cases of disputes resolved in court, the provisions of the Regulations and the relevant legal regulations in force in the Republic of Poland shall apply.

What can you do if you think we are processing your data in violation of legal requirements?

You can file a complaint with the supervisory authority. In Poland, this is the President of the Office for Personal Data Protection.

Why do we need your data, i.e. for what purpose do we process it?

The data will be processed for:

1. to enable you to participate in the contest named “Third Salon Tao Tao SPA” (hereinafter: “Contest”), to award and dispense prizes for participation in the Contest and to perform legal obligations related to the organization of the Contest – for the time necessary to organize the Contest and to fulfill all legal obligations incumbent on us, including tax obligations, but no longer than the expiration of the statute of limitations for any obligations that may arise from the organization of the Contest,
2. marketing involving the promotion of our goods and services and ourselves, including in connection with the Contest, and satisfaction surveys – for the duration of our performance of these activities, or to object to the processing of data for marketing purposes.

Do you have to give us your information?

This is voluntary, but without providing your contact information, you will not be able to participate in the Contest.

On what legal basis do we process your data?

1. Article 6(1)(c) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of natural persons with regard to the processing of personal data and on the free flow of such data and repealing Directive 95/46/EC (hereinafter referred to as “RODO”) to the extent that your data are processed for the purpose of performing the Administrator’s legal obligations, in particular those related to the settlement of payments for participation in the Contest and the issuance of prizes,
2. Article 6(1)(f) RODO, i.e. legitimate interest. Our legitimate interest is to conduct our marketing, including those related to the organization of the Contest and aimed at promoting our products or services, as well as satisfaction surveys.

To whom will we share your data?

1. marketing agencies,
2. providers of tools and platforms for registering for the Contest,
3. providers of email messaging tools,
4. To providers of tools for analytical and statistical purposes.

Will we use automated decision-making?

We will not apply automated decision-making mechanisms to you.

Once you have given us your data, can you object to its processing?

Yes. You can do so in two situations where we process your data:

1. for the purposes of direct marketing – you do not need to justify such an objection;
2. on the basis of our other legitimate interests – such objection requires justification of your particular situation.
